In these Terms, the term "you" or “your” refers to the user or viewer of the Site, and “dwoing.com”, “our”, “us”, or “we” refers to [Hrnbioed Industries private limited], the owner of this Site.

By accessing and/or using this Site, you confirm that you are competent to contract under the relevant local laws and that you agree to be bound by these Terms and any additional guidelines, restrictions, or rules that may be posted in connection with specific sections or services of this Site. All such additional posted guidelines, restrictions, or rules are hereby incorporated by reference into these Terms. We reserve the right to make changes to the Site and/or update these Terms at our discretion at any time without prior notice. Any change or modification to the Terms will be effective from the date of such update on the Site. Your continued use of the Site following the modifications to the Terms constitutes your acceptance of the modified Terms.

 

Please note that we do not print government-issued IDs or copyrighted images and content. If such materials are uploaded and not recognized by us, we cannot be held responsible.

Eligibility to use

It is strictly prohibited to sell, license, rent, modify, copy, reproduce, distribute, publish, or use any portion of the Content except to the extent expressly allowed in these Terms.

Use of Site

Account Creation and Use Before you can place an order online or use certain services or features offered on this Site, you will need a Dwoing account. We provide a single sign-on functionality, allowing you to use your log-in credentials across Dwoing services. By agreeing to these Terms and registering for a Dwoing account, you are granted permission to access and use this Site and Dwoing Content, including the design tools available on the Site, for the sole purpose of preparing, creating, designing, evaluating, and ordering products or services solely through Dwoing (referred to herein as “Products”). No other download, retention, use, publication, or distribution of any portion of the Dwoing Content is authorized or permitted. Obtaining Products from Dwoing does not entitle you to use any portion of Dwoing Content apart from the finished Products as they are supplied by Dwoing.

You represent, warrant, and confirm that where the Products contain any text, image, design, trademark, service mark, or any copyrighted work of any third party, you have obtained appropriate permission, consent, no-objection, authorization from such third party for such use prior to ordering the Products and shall provide a copy of such permission, consent, no-objection, authorization to Dwoing upon request. You further represent, warrant, and confirm to Dwoing that the Products ordered by you and made and printed for you by Dwoing do not infringe upon any rights of any third party, including copyright, trademark, tradename, right of publicity or privacy, and shall not cause libel, defame, abuse, harass, stalk, threaten, or violate the legal rights of any third party. You further agree that you will not publish, produce, post, upload, distribute, or disseminate any inappropriate, profane, defamatory, hateful, infringing, obscene, indecent, or unlawful topic, name, material, or information. By placing an order on this Site, you warrant that you have obtained all the necessary permission, consent, no-objection, authorization, right, and authority to place the order for the Products and you authorize Dwoing to produce the Products on your behalf.

You may not use this Site to send or use e-cards in any manner that would constitute the transmission of Spam or unsolicited e-mails. You may not use scripting or other programs to automate the creation and/or transmission of e-cards. Dwoing reserves the right, in its sole discretion, at any time, and without prior notice, to limit the number of recipients to which you may send an e-card and/or limit the number of e-cards that you may send.

You agree to use this Site in a responsible manner that is in full compliance with these Terms and with your local laws and regulations, including export and import regulations. You agree that you will not use the Site to produce Products that are offensive, unlawful, harassing, libelous, threatening, harmful, obscene, malicious, or otherwise objectionable. Dwoing reserves the right, in its sole discretion and without prior notice, to refuse to accept, or maintain any images, document layouts, templates, artwork, text, graphics, illustrations, logos, photos, audio, video, music, fonts, blog posts, trademarks, service marks, or other content uploaded or otherwise provided by you to Dwoing (“User Content”) or to process any order at any time and without assigning any reason. Dwoing also may terminate its service to and/or the accounts of customers found to be using Dwoing to engage in undesirable activities or otherwise violating these Terms.

User Content Responsibility You are solely responsible for your use of Dwoing Content in combination with any User Content you incorporate into your Products. Dwoing makes no representations concerning any content posted or produced by others through the Site. Dwoing is not responsible for anything produced on the Site or by using the tools available on the Site, including but not limited to the accuracy, copyright compliance, legality, or decency of content produced by you through the Site. You release us from all liability relating to or arising out of that content created by you and/or made by Dwoing pursuant to an order placed by you on the Site.

Compliance with Laws You agree not to create and order any Product displaying any content which is (i) in violation of the Emblems and Names (Prevention of Improper Use) Act, 1950, and the rules, schemes, guidelines issued thereunder, or (ii) showing a person to be a representative of a constituency as referred to in The Representation of the People Act, 1951, or any authority referred to thereunder. You alone shall be responsible for any liability arising out of such content or Product.

Reporting Unlawful Activity In the circumstance where Dwoing suspects your use of the Site and/or the Dwoing Content thereof or User Content to be unlawful, then notwithstanding any other rights available to Dwoing under these Terms and in law, Dwoing may report such suspected unlawful activity to law enforcement officials, and/or the relevant regulatory authority, and disclose such information relating to your Dwoing account, as may be necessary or called upon by such officials or authority including information relating to the email address(es) provided by you, contact details, usage history, posted materials, IP addresses, and traffic information.

Taxes and GST

​

You agree to pay any applicable taxes, including Goods and Services Tax (GST), that may be levied with respect to any product ordered by you on the Site. You shall ensure that the GST registration number and entity name, if applicable, correspond to the billing address provided. No change in these details will be allowed once the order is placed.

You acknowledge that dwoing.com will not be responsible for verifying your GST registration number and entity name. Any tax liability arising from non-compliance with applicable laws or due to furnishing incorrect information shall be borne by you. If the GST registration number is not provided at the time of order placement, it will be treated as 'unregistered,' and you may not be able to avail input tax credit. You are advised to independently assess your tax liability in such circumstances.

Shipping and Delivery

Delivery of Products All Products purchased from the Site shall be delivered to the Member by the Logistics Partner engaged by Dwoing.

Dwoing will endeavor to exercise its best efforts to provide expeditious delivery of the products on the estimated arrival date while placing the order. However, Dwoing cannot accept liability or be held financially responsible under any circumstances for any delay in delivery regardless of the cause of such delay. The Estimated Arrival Date is purely indicative and is subject to change due to conditions post placement of the order. Dwoing disclaims any claims or liabilities arising from any delays or damages for goods in transit. Dwoing shall not be held responsible and will bear no liability for delays or damages caused by, but not limited to, bad weather, flight delays, political disruptions, or other unforeseen circumstances. Any reasonable delay beyond Dwoing’s control will not constitute a deficiency of service on the part of Dwoing. Accurate Address Information You undertake to provide an accurate postal address to facilitate delivery by Dwoing. Incomplete address details are likely to result in loss or delay of shipment. Dwoing will not be held liable for delays or loss of shipments, or any other loss caused due to inaccurate and incomplete addresses. You will be liable to pay for the product or service which is undelivered due to the completeness/accuracy of the address provided at the time of placing the order. Dwoing will not be held liable for misplaced, lost shipments, delays, incorrect deliveries, or any other loss caused to the member. Factors Beyond Control Some deliveries are subject to factors outside of our control. This includes, but is not limited to, unforeseen geopolitical events, international trade complications, state laws, and terms and conditions or limitations imposed by our delivery partners. If we are unable to deliver a product due to these factors, we will either issue a refund or provide credit for any amount received in advance from the sale of such Product. Dwoing will not be held liable for the non-delivery of products resulting from these factors. Changes to Orders You acknowledge that where you request a change to the Product, address, or any other details pertaining to the Product or service provided by Dwoing subsequent to the placement of the order, such a change will result in a change to the original Estimated Arrival Date, subject to the availability of the Product at the time and post such change request. While Dwoing will endeavor to accommodate such changes requested subsequent to the placement of an order, Dwoing shall not be held liable under any circumstances for non-execution of such change requests. Disposal of Products Dwoing shall be entitled to dispose of the Products ordered by you in the event that you are not available for delivery or refuse a second delivery within 7 days of the first delivery attempt. While all reasonable care and precautions are taken while disposing of a Product, Dwoing shall not be liable in any manner whatsoever for any misuse of the Product post such disposal by Dwoing.


Pricing Policy

All prices, fees, discounts, and promotions posted on the Site are subject to change without notice and are not guaranteed. Placing a product in your cart does not reserve the price shown at that time. The price charged for a Product will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Price increases will only apply to orders placed after such changes. Dwoing.com shall not be held liable for any fluctuations in the price of the Product.

Refunds

Refunds, if any, shall be made to the same issuing bank through which the Product/Service was purchased. For cash on delivery transactions, the Member has the option to receive the refund in any bank account via NEFT, and it is the responsibility of the Member to share valid bank details to avail the said return. Refunds shall be made in Indian Rupees only and shall be equivalent to the Transaction Price received in Indian Rupees.

For payments made through electronic means like debit card, credit card, net banking, wallet, etc., refunds shall be made using the same payment mode or any other online banking/electronic funds transfer system approved by the Reserve Bank of India (RBI). Refunds may be supported for select banks. Where a bank is not supported for processing refunds, you will be required to share alternate bank account details with us for processing the refund. Refunds shall be conditional and shall be with recourse available to Dwoing in case of any misuse by you. We may also request additional documents for verification.

Dwoing reserves the right to refuse to process transactions from you if you have a prior history of questionable charges, including without limitation breach of any agreements by you with Dwoing or breach/violation of any law or any charges imposed by the Issuing Bank or breach of any policy.

​

Upon request from you, Dwoing will provide ARN (Acquirer Reference Number) or UTR (Unique Transaction Reference Number) to you for refunds made to you. However, in the event of non-receipt of such a refund in the designated Bank Account, it will be your responsibility to provide Dwoing with the set of documents required to support the claim of non-receipt.

Dwoing, through its payment service provider, shall initiate the refund procedure subject to satisfactory verification of the documents provided by the member.

​

If you choose to avail Merchant Credit in lieu of a refund, such credit will be available for use by you for a period of forty-five (45) days. Post such period, the Merchant Credit shall lapse and would not be usable for any future payments by you.

Indemnification

You agree to indemnify Dwoing.com, our affiliates, directors, officers, employees, agents, and all parties from whom Dwoing.com has licensed portions of its content, against all claims, liabilities, damages, costs, and expenses, including reasonable legal fees and expenses, arising out of or related to:1.Your breach of these Terms or any applicable laws.2.Any suit, claim, or demand arising from or relating to any text, photograph, image, graphic, or other material that was not part of the Dwoing.com content and that you uploaded or otherwise provided to Dwoing.com or incorporated into products.

Dwoing.com reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims. You agree not to settle any matter without the prior written consent of Dwoing.com. We will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.

Disclaimer of Warranty

The site and Dwoing.com content are provided "as is" without warranty of any kind, either expressed or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement. You acknowledge that operation of the site may not be uninterrupted or error-free. While we make reasonable efforts to accurately display the attributes of products, we do not warrant that product descriptions are accurate, reliable, and error-free. References and links to products or services of independent companies may appear on the site. These references and links are provided "as is" without warranty of any kind, either expressed or implied.

Some jurisdictions may provide you with certain warranties or guarantees that cannot be excluded by contract ("consumer guarantees"), or only limited in certain circumstances, and nothing in these Terms alters those consumer guarantees if applicable to you. Nothing contained in these Terms shall be illegal or voidable by reason of containing any provision which could be interpreted as limiting any of the consumer guarantees available to you. If those consumer guarantees apply to you, and Dwoing.com cannot legally exclude any consumer guarantees, then to the maximum extent permitted by law, Dwoing.com:

• Limits its liability at the option of Dwoing.com to the following:
  A. In the case of services, the supply of the services again or the payment of the cost of having the services supplied again.
  B. In the case of goods, the replacement of the goods or the supply of equivalent goods; the repair of the goods; the payment of the cost of replacing the goods or acquiring equivalent goods; or the payment of the cost of having the goods repaired.
   

If you request a refund, the time it takes for your refund to arrive may depend on your bank. In most cases, you should receive your refund within 30 days. Certain circumstances are beyond Dwoing.com's control and may not be covered by the Satisfaction Guarantee. Please note that Dwoing.com shall not be responsible for:1.Spelling, punctuation, or grammatical errors made by you.2.Inferior quality or low-resolution of uploaded images.3.Design errors introduced by you in the document creation process.4.Errors in user-selected options such as choice of finish, quantity, or product type.5.Damage to the products arising after delivery to you.
 

Please preview your designs carefully and correct any mistakes and satisfy yourself prior to placing your order. Dwoing.com does not proof documents created by its users prior to processing any product.

 

 

Limitation of Liability

Under no circumstances shall Dwoing.com or its licensors, suppliers, or vendors, or their respective officers, directors, employees, contractors, or agents, be liable for any special, incidental, indirect, or consequential damages of any kind, or for any damages whatsoever resulting from loss of use, data, or profits, whether or not Dwoing.com has been advised of the possibility of damage, arising out of or in connection with the use or performance of the site or the failure to provide products or services that you order from Dwoing.com or its affiliates. This includes, without limitation, damages arising from mistakes, omissions, viruses, delays, or interruptions of service. In no event shall Dwoing.com be liable or responsible for any damages or consequences arising from or related to your inappropriate or unauthorized use of this site or its content or our supplied products or services. If you live in a country or state that does not allow any of the foregoing exclusions or limitations of liability or any of the disclaimers of warranties in the above section, such exclusions or limitations will not apply to you but only to the extent such exclusions or limitations are not allowed. Governing Law

All issues related to the protection, infringement, or misuse of copyrighted materials shall be governed by the copyright laws of the United States of America. All other matters relating to your access to, or use of this site shall be governed by the laws of India. Any legal action or proceeding relating to or arising from your access to or use of this site shall be instituted in Mumbai, India. The courts in Mumbai shall have exclusive jurisdiction in respect of any matters arising herefrom. You agree to submit to the jurisdiction of the courts of Mumbai, India and agree that venue in these courts is proper in any such legal action or proceeding.

Transfer of Title

You agree that the risk of loss and title for any printed Product pass to you upon our delivery to our carrier. For any Product that is to be provided to the customer in an electronic format, the customer agrees that delivery of such Product shall be deemed to have occurred either (a) at the time we transmit the Product via email or other electronic communication addressed to the customer or (b) at the time we transmit a notification to the customer that the Product is available for downloading from the Site.
